1. Introduction
Welcome to Fitness Made Simple, LLC (“Company,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of our services, programs, website, and any related platforms. By enrolling in our programs, purchasing our services, or accessing our online platforms, you agree to these Terms. If you do not agree, do not use our services.
2. Services Provided
By enrolling in our coaching programs, you will receive:
Personalized training programs based on your condition and goals, updated as needed (typically every 6 weeks).
Personalized macronutrient plan, assessed weekly and adjusted as needed. Includes meal prep lists and meal ideas.
Access to communication via text, email, app messenger, group chat, and scheduled phone calls (responses within 24 hours, Monday–Saturday).
Weekly check-ins to assess progress, maintain accountability, and address concerns.
3. Payments & Refunds
You agree to commit to the 12–26 week program.
No refunds are offered unless:
You have followed all program requirements for the full term (nutrition, training, daily check-ins, no skipped workouts, no meal plan deviations),
and
You have made zero progress, as determined by your coach.
All payments are due as agreed upon at purchase. Failure to make payment may result in suspension or termination of services.
4. Program Requirements
To be eligible for the refund guarantee, you must:
Submit daily meal pictures.
Provide a daily accountability photo (gym or active rest).
Complete all weekly check-ins on time.
Follow the meal plan with no cheats.
Complete all scheduled training sessions.
5. Disclaimers
We are not medical professionals and do not provide licensed healthcare, diagnosis, or treatment.
Our services are for fitness, nutrition, and lifestyle guidance only.
You should consult your physician before starting any program.
Do not stop prescribed medications without your doctor’s approval.
6. Personal Responsibility & Liability Release
You assume all risks associated with lifestyle changes, diet, training, and supplement use.
You release Fitness Made Simple, LLC and its coaches from any and all liability for injuries, illnesses, or damages, except in cases of gross negligence.
7. Confidentiality
We keep your information private and will not share it except as required by law.
8. Progress Photos
By enrolling, you consent to us using your progress photos for marketing purposes, unless you revoke consent in writing.
9. Termination of Services
We reserve the right to terminate your participation if you violate program rules, behave inappropriately, or fail to make required payments.
No refunds will be issued for terminated accounts.
10. Website Use & Intellectual Property
You agree not to misuse our website or engage in prohibited activities (e.g., hacking, spamming, posting unlawful content).
All content, programs, and materials are owned by Fitness Made Simple, LLC.
You may not copy, distribute, or resell our content without written permission.
11. SMS & Email Communication Consent (A2P Compliance)
By providing your phone number and/or email, you agree to receive messages from Fitness Made Simple, LLC related to your program, including reminders, updates, and promotional content.
You may opt out at any time by replying STOP to SMS or using the unsubscribe link in emails.
Message and data rates may apply.
12. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of Louisiana, USA.
Any disputes will be resolved through binding arbitration in accordance with the Canadian Arbitration Association Arbitration Rules.
The sole remedy available in arbitration is a refund of the program fee. No consequential damages may be awarded.
13. Changes to Terms
We may update these Terms from time to time. Continued use of our services after changes means you accept the updated Terms.
